Welcome to Emoto Decalz. By accessing our website and placing an order, you agree to be bound by the following terms and conditions. Please read them carefully before making a purchase.
1. General
These terms and conditions apply to all purchases made through the Emoto Decalz website (emotodecalz.com). By using this website you acknowledge that you have read, understood and agree to these terms. We reserve the right to update these terms at any time without prior notice.
2. Products and Pricing
- All prices are listed in Australian Dollars (AUD)
- We reserve the right to change prices at any time without notice
- Product images are for illustration purposes and actual colours may vary slightly due to screen settings and printing processes
- We make every effort to ensure product descriptions are accurate, however minor variations may occur
3. Orders
- By placing an order you are making an offer to purchase the selected products
- An order confirmation email does not constitute acceptance of your order
- We reserve the right to refuse or cancel any order at our discretion
- Orders are processed within 2-3 business days
4. Custom Orders
Custom designed products (including decals created through our Design Studio) are made to order specifically for you. As such:
- We will send a proof via email before creating the final decal
- Custom orders are non-refundable and non-exchangeable
- Please ensure your design and details are correct before placing the order
- We are not responsible for errors in customer-supplied designs or information
- If there is a manufacturing defect on a custom order, we will provide a replacement at no cost
5. Payment
Payment is processed securely through our third-party payment provider, Stripe. We accept major credit and debit cards including Visa and Mastercard. We do not store your payment card details on our servers.
6. Shipping and Delivery
- Orders are shipped from Sydney, Australia via Australia Post
- Delivery times are estimates only and are not guaranteed
- We are not liable for delays caused by Australia Post or circumstances beyond our control
- Risk of loss passes to the customer upon dispatch
- Local pickup is available in Sydney by arrangement

7. Returns and Refunds
- Returns are accepted within 7 days of delivery for non-custom items
- Items must be unused and in original condition
- Custom designed products are non-refundable
- Faulty items will be replaced or refunded under our 12 month warranty
- Return shipping costs are the responsibility of the customer unless the item is faulty

8. Intellectual Property
- All content on this website including logos, images, designs and text is the property of Emoto Decalz and is protected by Australian copyright law
- You may not reproduce, distribute or use any content from this website without our written permission
- Customer-uploaded designs remain the property of the customer. By uploading a design you confirm that you own the rights to that design or have permission to use it
- We are not responsible for any copyright infringement in customer-supplied designs
9. Limitation of Liability
To the maximum extent permitted by Australian Consumer Law:
- Our liability is limited to the purchase price of the product
- We are not liable for any indirect, incidental or consequential damages
- We are not liable for damage caused by improper application or use of our products
- Nothing in these terms excludes or limits your rights under the Australian Consumer Law
10. Australian Consumer Law
Our products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the products repaired or replaced if the products fail to be of acceptable quality and the failure does not amount to a major failure.
11. Privacy
Your personal information is handled in accordance with our Privacy Statement and the Australian Privacy Act 1988.
12. Governing Law
These terms and conditions are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
